Criminal Law

Federal and state crimes

Alfred Ramirez has extensive jury trial experience in federal and state court.  There are two sets of criminal laws: the system of criminal laws passed by the Texas Legislature which are found in the Texas Penal Code and the system of criminal laws passed by the United States Legislature and are found the United Stated Code.

  1. Federal Crimes

Federal crimes are independent allegations from Texas’ state charges. The Federal system have their own crimes (most are found in Title 18 of the United States Code) and with their own punishments.  Federal defendants convicted of charges will face sentencing before a federal judge who will refer to the Federal Sentencing Guidelines and the federal sentencing table in deciding how long the person will be sentenced to time on probation or prison. In Texas, there are four federal districts:

  • Eastern District of Texas (Divisions: Beaumont, Lufkin, Marshall, Sherman, Texarkana, Tyler)
  • Northern District of Texas (Divisions: San Antonio, Ft. Worth, Amarillo, Abilene, Lubbock, San Angelo, Wichita Falls)
  • Southern District of Texas (Divisions: Brownsville, McAllen, Laredo, Corpus Christi, Victoria, Galveston, Houston)
  • Western District of Texas (Divisions: Austin, Del Rio, El Paso, Midland-Odessa, Pecos, San Antonio, Waco)
  • United States Court of Appeals for the Fifth Circuit

Alfred Ramirez is currently licensed and has practiced in each of the four district courts of Texas and in the 5th Circuit Court of Appeals.   Federal Charges in the Del Rio, Division of the Western District of Texas Although his office is located in San Antonio, Alfred Ramirez makes the three hour commute from San Antonio to Del Rio almost weekly for court hearings and to meet with clients.   The Del Rio Division comprises the following counties: Edwards, Kinney, Maverick, Terrell, Uvalde, Val Verde and Zavala.  If a person is arrested on federal charges in any of theses counties, the case will be filed in federal court in the Del Rio Division of the Western District of Texas.  The South Texas border area extends from Del Rio, Texas (Val Verde County) in the western district to Willacy and Cameron Counties along the Gulf of Mexico. The population in the region is concentrated in three areas--Del Rio/Eagle Pass, Laredo, and the Lower Rio Grande Valley. The South Texas portion of the U.S.-Mexico border is extremely rural and contains long stretches of uninhabited or sparsely populated land that is often used by drug traffickers to smuggle illicit drug shipments into the United States and by traffickers attempted to transport undocumented alines into the United States. They also use these areas to temporarily store drug shipments and undocumented aliens before transporting them to larger towns and cities within the interior of the United States. A bustling cross-border economy in the region provides additional avenues for drug smuggling operations. Traffickers exploit the transportation infrastructure that supports cross-border business to transport to other areas of Texas and the United States. As a division that sits alone the Mexican border, Alfred Ramirez has extensive experience and is prepared to defend clients against the following very serious charges that are predominately filed in the Del Rio Division:

  • Transportation and conspiracy to transport illegal aliens/undocumented aliens. (8 U.S.C. §1324
  • Possession and Conspiracy to Possess Controlled Substances
  • Illegal Entry to the United States
